Terms of Service

Effective October 27, 2026

These Terms of Service ("Terms") are an agreement between you and AwardWhiz LLC, a Washington limited liability company ("AwardWhiz", "we", "us" or "our"). They govern your use of the awardwhiz.com website, the AwardWhiz API, the AwardWhiz connector for AI assistants (our MCP server), our emails, and any other service that links to these Terms (together, the "Service"). Our Privacy Policy explains how we handle your information and is part of these Terms.

Please read these Terms carefully. Section 18 contains a binding arbitration agreement and a class action waiver that affect how disputes are resolved. You can opt out of arbitration within 30 days as described there. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a company or other organization, you agree to these Terms for that organization and confirm you have authority to do so. You may not use the Service if you are located in a country subject to a U.S. government embargo or are on a U.S. government list of prohibited or restricted parties.

2. What AwardWhiz does

AwardWhiz helps you research award travel. The Service searches award (points and miles) flight availability across airline loyalty programs, keeps a history of your searches and links you to airline websites to book. Some features may be in beta or available only to invited users.

AwardWhiz is a research tool. We do not sell, issue or book tickets, we do not buy, sell or transfer points or miles, and we are not a travel agency, airline, bank, credit card issuer or financial advisor. You book directly with the airline or loyalty program.

3. Your account

  • Give us accurate information when you sign up, including a real email address you can verify, and keep it up to date.
  • Keep your password, API keys and connected devices secure. You are responsible for everything done with your account, including by apps and AI assistants you authorize.
  • Your account is for you alone. Do not share it, sell it or let others use it, and do not create multiple accounts to get around limits.
  • Tell us right away at [email protected] if you believe your account has been accessed without your permission.
  • If you sign in with a third-party account, your use of that provider is also subject to its terms.

4. Award availability, prices and booking

Award availability is gathered from airline and loyalty program websites and other sources, and it changes constantly. Results may be cached, delayed, incomplete or wrong. Seats can disappear before you book, and some availability shown by an airline cannot actually be booked (sometimes called "phantom" availability). Points, taxes, fees, schedules, durations, cabins, fare classes and routing rules shown in AwardWhiz are estimates.

  • Always confirm availability, price, fare rules, cancellation and change rules, and passport, visa and health requirements with the airline or program before you book or transfer points.
  • Transfers of credit card or hotel points to an airline program are usually irreversible. Confirm the seat is bookable before you transfer. We are not responsible for points you transfer or spend based on information from the Service.
  • Booking links take you to third-party websites. Your booking, and the airline or program's handling of your account, are governed by that provider's terms, and the provider alone is responsible for your ticket and travel.
  • Do not rely on the Service as your only source of information.

5. Airlines, loyalty programs and trademarks

AwardWhiz is independent. Unless we say otherwise, we are not affiliated with, endorsed by or sponsored by any airline, hotel, loyalty program, credit card issuer or bank. Their names and logos are trademarks of their owners and are used only to identify their programs. Each loyalty program sets its own rules, and those rules may limit how you may earn, redeem, transfer or share points and miles. You are responsible for following them.

Information in the Service is general information, not financial, credit, tax, legal or investment advice, and it does not consider your personal situation.

Some links in the Service may be affiliate or referral links, which means we may earn a commission or other compensation if you apply, sign up or buy something through them. That compensation may affect which links we show and where they appear. We will label sponsored placements.

7. Paid plans, billing and cancellation

AwardWhiz is currently free to use, though access to some features is limited. If you buy a paid plan or service:

  • We will show you the price, billing period and any free-trial terms before you pay. Prices do not include applicable taxes, which you agree to pay.
  • Subscriptions renew automatically at the end of each billing period, and you authorize us and our payment processor to charge your payment method until you cancel. If a free trial converts to a paid plan, we will charge you when the trial ends unless you cancel first.
  • You can cancel at any time. Cancellation stops future renewals, and you keep paid features until the end of the current billing period.
  • Except where the law requires otherwise or we state otherwise at purchase, payments are non-refundable and we do not give credits for partial periods or unused features.
  • We may change prices or plan features. We will give you advance notice of a price change, and it will apply from your next renewal after the notice.
  • If a payment fails or you dispute a valid charge, we may suspend or downgrade your account.

8. API keys and AI assistants

You can create API keys or connect AI assistants and other apps (for example through our MCP server) to run searches with your account.

  • API keys are confidential and personal to your account. Do not publish them or embed them in apps other people use.
  • Searches made with API keys or connected apps count toward your account's limits. We may set, change and enforce rate limits and may revoke keys or connections that put the Service at risk.
  • When you connect a third-party app, you authorize it to act for you within the permissions you approve. Its provider's terms and privacy policy govern what that app does with the information it receives. You are responsible for its use of your account, and you can disconnect it at any time in your account settings.
  • AI assistants can summarize or present our results inaccurately. Check the details on the booking site before acting on them.
  • Unless we agree in writing, API and connector access is for your personal, non-commercial use, and you may not redistribute, publicly display or resell our results.

9. Acceptable use

You agree not to, and not to help anyone else to:

  • scrape, crawl or otherwise copy the Service or its data by automated means, except through the API or connector features we provide and within their limits;
  • resell, sublicense, redistribute or commercially exploit the Service or its data, or use it to build a competing product or dataset;
  • use the Service to broker, buy, sell or barter points, miles or award tickets, or in any other way that violates a loyalty program's rules;
  • get around rate limits, access restrictions, bot protection or other security measures, or probe, scan or test the Service's vulnerabilities without our written permission;
  • interfere with the Service, overload it, or introduce malware or harmful code;
  • reverse engineer or decompile the Service, except where the law expressly allows it;
  • use the Service or its content to train machine learning or AI models, other than an AI assistant processing your own searches for you;
  • impersonate anyone, give false information, or access another person's account or data without permission; or
  • use the Service for anything illegal, fraudulent or harmful.

10. Your content and feedback

You keep ownership of the information you submit, such as your searches and settings ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce and display Your Content as needed to operate, secure and improve the Service, and to create aggregated or de-identified data that no longer identifies you.

If you send us ideas, suggestions or other feedback, we may use them without restriction or payment to you.

11. Our intellectual property

The Service, including its software, design, text, graphics, compilations of data and the AwardWhiz name and logo, belongs to AwardWhiz or its licensors and is protected by law. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable license to use the Service for your own travel planning. All rights not expressly granted are reserved.

If you believe content on the Service infringes your copyright, email [email protected] with a description of the work, where it appears on the Service, your contact information, a statement that you have a good-faith belief the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are authorized to act for the owner, and your physical or electronic signature. We may remove the content and terminate repeat infringers.

13. Communications

You agree that we may send notices, disclosures and other communications electronically, by email to the address on your account or within the Service, and that they satisfy any requirement that they be in writing. We send account and security emails as part of the Service. You can opt out of marketing emails using the unsubscribe link.

14. Changes, suspension and termination

We may change, limit, suspend or discontinue all or part of the Service, including which airlines and programs we search, at any time. We may suspend or terminate your access, revoke API keys or connections, or delete your account if you violate these Terms, if we believe your use puts the Service, other users or third parties at risk, or if required by law. If we discontinue a paid feature you have prepaid for, we will refund the unused part of your payment.

You can stop using the Service at any time. To delete your account, email [email protected] or use an account deletion option if one is available in your settings. Sections that by their nature should survive, including those on amounts owed, your content, intellectual property, disclaimers, limitation of liability, indemnity and dispute resolution, survive termination.

15. Disclaimers

The Service and all information in it are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Service will be uninterrupted, secure or error-free, that award availability or prices shown are accurate or bookable, or that any defects will be corrected. We are not responsible for the acts, omissions, products, services, websites or policies of airlines, hotels, loyalty programs, card issuers, AI assistants or other third parties.

16. Limitation of liability

To the fullest extent permitted by law, AwardWhiz and its members, managers, employees, contractors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, points, miles, award seats, travel opportunities or goodwill, arising out of or relating to the Service or these Terms, even if we were told such damages were possible. Our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim or US $100.

Some jurisdictions do not allow certain disclaimers or limits on liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

17. Indemnity

To the extent permitted by law, you will defend, indemnify and hold harmless AwardWhiz and its members, managers, employees and contractors from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or of any law or third-party right (including a loyalty program's rules), Your Content, or the use of your account by you or anyone you authorize.

18. Dispute resolution and arbitration

Try us first. Before filing a claim, email [email protected] with a description of the dispute and the relief you want. We will try to resolve it informally within 60 days.

Binding arbitration. If we cannot resolve it, you and AwardWhiz agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. The arbitration will take place in the county where you live or by video, and the arbitrator may award the same individual relief a court could. Either party may instead bring an individual claim in small claims court, and either party may ask a court to stop infringement or misuse of intellectual property.

Class action waiver. You and AwardWhiz may bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated or representative proceeding, and both of us waive any right to a jury trial. If this waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration.

Opting out. You may opt out of this arbitration agreement by emailing [email protected] from your account email address within 30 days after you first accept these Terms, stating that you opt out. If we make a material change to this section, you may reject it by emailing us within 30 days of the change.

19. Governing law and general terms

These Terms are governed by the laws of the State of Washington and applicable U.S. federal law, without regard to conflict-of-law rules. Except for claims that go to arbitration or small claims court, the exclusive venue for disputes is the state and federal courts located in the State of Washington, and you and AwardWhiz consent to their jurisdiction. If you live outside the United States, you may also have the benefit of mandatory consumer protection laws where you live.

These Terms, together with any additional terms you accept for a specific feature, are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.

20. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and update the effective date. If you keep using the Service after changes take effect, you accept them. If you do not agree, stop using the Service and delete your account.
